OF THE GENERAL LEGAL COUNCIL MADE ON COMPLAINT
No. 9 of 1999

DESRENE HANSON-DOUGLAS vs DONALD BERNARD DISBARRED ATTORNEY-AT-LAW

AND

UPON THE APPLICATION dated 24th March, 1999 made under section 12 (1)(A) of the Legal Profession Act coming on for hearing before the Disciplinary Committee on the 1st April, 2000, and 3rd May 2000

AND UPON the complainant Desrene Hanson-Douglas appearing and having given evidence on oath

AND UPON the attorney-at-law Donald Bernard not appearing on the 1st, April, 2000 AND 3rd May 2000 and having not given evidence on oath

AND UPON the Committee being satisfied that the Notice of this hearing was properly served on the attorney

AND UPON DUE CONSIDERATION of the evidence of Mrs. Desrene Hanson-Douglas

THE COMMITTEE FOUND that the attorney-at-law Mr. Donald Bernard is guilty of Professional Misconduct

PURSUANT TO THE FOREGOING FINDINGS, THE COMMITTEE UNANIMOUSLY HEREBY ORDERED THAT:­

  1. The Respondent attorney whose name is already struck from the roll of attorneys-at-law entitled to practise in the several Courts of the Island of Jamaica, pays the sum of $185,759.47 to the complainant with interest at 18% from 28th May, 1996.
  2. The respondent pays the complainant costs in the sum of $5,000.00 This Order is made under section 12(4) of the Legal Profession Act.
