UPON THE APPLICATION dated 14th April, 2003 made under section 12(1)(a) of the Legal Profession Act and coming on for hearing before the Disciplinary Committee on the 12th March, 2005 and 19th November, 2005
AND UPON the complainant Barbara Fairclough-Hill appearing and having given evidence on oath ·
AND UPON the attorney-at-law Mr. Hensley Williams not appearing
AND UPON DUE CONSIDERATION of the evidence of Mrs. Barbara Fairclough-Hill
THE COMMITTEE FINDS that the attorney-at-law Mr. Hensley Willi s is guilty of misconduct in a professional respect and that he is in breach of Canons IV o) & (p) in that he has withdrawn from her employment without giving proper notice and that he did not refund any part of the fees paid in advance.
PURSUANT TO THE FOREGOING FINDINGS, THE COMMITTEE UNANIMOUSLY HEREBY ORDERED THAT:
- The Attorney Hensley Williams under section 12( c) pays to the complainant by way of restitution the sum of $110,000.00 being fees paid by her to the attorney within thirty (30) days of the 19th November, 2005 failing which interest will accrue at the rate of 12% per annum thereafter.
- Cost of $5000.00 be paid to the General Legal Council by the attorney.
These Orders are made under section 12(4) of the Legal Profession Act.
