COMPLAINT No. 100/2000

Mr. Kevin Martin was called but there was no answer. The Panel heard evidence from Dr. Lloyd Barnett and referred to the Affidavit of Service of Eulalee Steele sworn on the 10th October, 2001 which confirmed service of the complaint by post. The Panel finds as follows:­

  1. That the attorney Kevin Martin has been convicted of the offences of fraudulent conversion contrary to section 24 of the Larceny Act on the 25th May, 1999 and 13th September, 1999.
  2. In the circumstances the Attorney has contravened the Legal Profession (Prescribed offences) Rules 1998 and S12 (1) (b) of the Legal Profession Act. In addition the Attorney has failed to maintain the honour and dignity ofhis profession and has brought it into disrepute contrary to canon I(b) of the Legal Profession (Canons of Professional Ethics) Rules.

Pursuant to Section 12(4)(a) of the Legal Profession Act it is hereby Ordered that:

  1. The name of Kevin Martin be struck off the Roll of Attorneys-at-law entitled to practice in the several Courts of the Island of Jamaica
  2. Costs of $10,000.00 awarded to the General Legal Council be paid by Mr. Kevin Martin.
