NO. 225 of 1991

UPON THE APPLICATION dated 31st October, 1991 made under Section 12 (1) (A) of the Legal Profession Act coming on for hearing before the Disciplinary Committee on the 20th February 1993, 30th October 1993, 15th January 1994, 12th March 1994, 9th March, 1996 and 2nd May, 1997

AND UPON the Complainant, Ms. Valerie Brown appearing and giving evidence on oath

AND UPON the attorney-at-law Melbourne Silvera appearing and giving evidence  on  oath

AND  UPON  DUE  CONSIDERATION  of the evidence

THE COMMITTEE  FOUND Attorney-at-law Melbourne Silver guilty of misconduct in a professional respect.

PURSUANT TO THE FOREGOING FINDING, THE DISCIPLINARY COMMITTEE UNANIMOUSLY ORDERED:­-

(On 9th March, 1996)

That the Attorney-at-law Melbourne Silvera, be suspended for Nine (9) months from March 9, 1996.

(On 2nd May 1997)

That the said attorney-at-law do pay to the complainant by way of costs the sum of $20, 000.00

That the said attorney-at-law do pay to the complainant the sum of $30,000.00 by way of restitution pursuant to Section 12 (4) (b) and (c) of the Legal Profession Act.

The Panel wishes to clarify that nothing in this Order is intended to affect any common-law rights that the complainant may have arising out of the matter grounding the complaint .
