OF THE GENERAL LEGAL COUNCIL MADE ON COMPLAINT
No. 162 Of 1998

DECISION DELIVERED – 19th FEBRUARY, 2000

UPON THE APPLICATION dated 27th May, 1998 made under section 12 (1) (A) of the Legal Profession Act coming on for hearing before the Disciplinary Committee on the 4th December 1999, 19th February, 2000.

AND UPON the Complainant Sylvia Bryan appearing on the 4th December, 1999 and 19th February 2000 and having given evidence on oath

AND UPON the attorney-at-law Mr. Winston Walters not appearing on the 4th December, 1999 and 19th February, 2000 and having not given evidence on oath

AND UPON DUE CONSIDERATION of the evidence of Sylvia Bryan the Committee made the following findings:

  1. That the complainant paid the sum of $246,862 for the purchase of property at #12 Wellington Street, Browns Town, Kingston 16, registered at Volume 605 Folio 50
  2. That the complainant paid in full all monies required to complete the purchase and the attorney gave her possession on the 13th October, 1995
  3. That to date the complainant is not registered as proprietor of the said property.
  4. That the attorney has not proceeded with the matter with expedition to effect transfer to the complainant and that he has not explained or accounted to the complainant

THE COMMITTEE FOUND therefore that the attorney is in breach of Canon IV (R) & (S)

PURSUANT TO THE FOREGOING FINDING, THE DISCIPLINARY COMMITTEE UNANIMOUSLY ORDERED THAT

  1. The Attorney Winston Walters deliver to the complainant, Sylvia Bryan, all documents in a registerable form and inclusive of the Duplicate Certificate of Title registered at Volume 605, Folio 50 of the Registered Book of titles and registration fees, in order to effect the transfer of the said property to the complainant Sylvia Bryan, Higgler of 12 Wellington Street, Browns Town, Kingston 16
  2. That the Delivery of the Said Document be on or before the 31st May, 2000.
  3. That the attorney pays a fine of $50,000.00 to the complainant Sylvia Bryan on or before the 31st May 2000 .
