UPON THE APPLICATION dated 10th April, 2003 made under section 12(1)(a) of the Legal Profession Act and coming on for hearing before the Disciplinary Committee on the 3rd July, 2004.
AND UPON the attorney-at-law, Mr. Winston Walters, not appearing nor was he represented
AND UPON reading the affidavit of Mervalyn Walker stating that notice of the hearing was sent by registered post to the attorney at his office address, 8 Haughton A venue, Kingston 10.
AND UPON the complainant, Ms. Beverley Grant, appearing and having given evidence on oath
AND UPON DUE CONSIDERATION of the sworn evidence of the complainant, Ms. Beverley Grant,
THE COMMITTEE FINDS that the complainant has proved her case. In the circumstances the Committee found that the respondent is guilty of misconduct in a professional respect.
PURSUANT TO THE FOREGOING FINDINGS THE COMMITTEE UNANIMOUSLY HEREBY ORDERED THAT:-
Pursuant to section 12(4) of the Legal Profession Act:
- The name of the attorney, Winston Walters, be struck from the Roll of attorneys-at-law entitled to practise in the several Courts of the Island of Jamaica
- By way of restitution the attorney, Winston Walters, is to pay to the complainant the sum of US$1,587.00 and J$12,000.00 respectively with interest thereon at the rate of 12% per annum commencing from the 1st August 2001.
These orders are made under section 12(4) of the Legal Profession Act.
