COMPLAINT NO: 139/2017

UPON THE APPLICATION made under section 12 (1) (a) of the Legal Profession Act and dated the 19th day of July 2017 coming on for hearing before the Disciplinary Committee on the 3Ro February, 2018, 14th April, 2018, 5th May 2018, 2nd June, 2018 and 15th September, 2018.

AND UPON the Respondent Attorney-at-law Courtney Kazembe not appearing on the 3rd February, 2018, 14th April, 2018 but appearing with Counsel Akuna Nobel on the 5th May 2018, and with Counsel Ian Wilkinson and Akuna Nobel 2nd June, 2018 and on 15th September, 2018

AND UPON Complainant Allan Wood, Q.C. appearing on all the hearing date but with Counsel Candice Williams 3Ro February, 2018, 2nd June, 2018 and 15th September, 2018 and having given evidence on oath

AND UPON Attorney for the Respondent submitting in mitigation pursuant on sanction, the Attorney admitting through his Counsel to having committed breaches of the Legal Profession (Accounts and Records) Regulations for the years, 2002, 2003, 204 2005, 2006, 2007, 2008, and 2010, 2011, 2012, 2014 and 2015 contrary to sections 16 (1) and 17 of the said Regulations.

AND UPON the Committee finding that such breaches by the Attorney Courtney Kazembe amounted to professional misconduct contrary to section 12(1) (a) of the Legal Profession Act.

PURSUANT TO THE FOREGOING FINDINGS THE COMMITTEE UNANIMOUSLY ORDERED THAT: –

The Attorney at-law Courtney Kazembe should pay a fine of $50,000.00 for each year that he was found to be in breach of the Legal Profession (Accounts and Records) Regulations 1999, plus costs of $50,000.00 amounting to a sum of $650, 000.00 to the Genera l Legal Council on or before 21st December, 2018.
