COMPLAINT NO. 217/90

Probyn Aitken, Attorney-at-Law

In the matter of the Legal Profession Act.

UPON THE APPLICATION DATED the 22nd day of February, 1991 MADE UNDER SECTION 12(1)(a) OF THE LEGAL PROFESSION ACT before the Disciplinary Committee at a hearing on the 1st day of June, 1991 with Mr. Christopher Bovell as Chairman together with Mrs. Pamela Benka-Coker and Mr. Derek Jones AND UPON DUE CONSIDERATION of the evidence and documents relating to the allegations contained in the Affidavit which accompanied the said application THE COMMITTEE FOUND that:

On the 8th day of May, 1990 at the Resident Magistrate’s Court for the Parish of Kingston, holden before Her Honour Mrs. Z. McCalla, Probyn Aitken, pleaded guilty and was convicted of the criminal charge of having conspired to defraud the Government of Jamaica by fraudulently utilizing funds held by the Jamaica Liaison Service and the West Indies Central Labour Organisation on behalf of the said Government of Jamaica for their own benefit or purposes and was sentenced to nine(9) month’s imprisonment.

ACCORDINGLY, Probyn Aitken is found guilty of misconduct in a professional respect pursuant to Canons 1(b) and III(k) of the Legal Profession (Canons of Professional Conduct) Rules 1978.

PURSUANT TO THE FOREGOING FINDING the Disciplinary Committee voting unanimously HEREBY ORDERS that the name of Mr. Probyn Aitken, Attorney-­at-Law be struck off the Roll.
