Please note
- On 9th February 2023 the decision of the Judicial Committee of the Privy Council was delivered which reinstated the decision of the Full Court.
- By the aforesaid decisions it was held that s. 91A, 94 and 95 of the Proceeds of Crime Act, the Regulations thereunder and the Orders and Guidance of the General Legal Council including the amendment to reg. IV(t) of the Legal Profession (Canons of Professional Ethics) Rules was not unconstitutional.
- Accordingly as the competent authority for the Legal Profession, the General Legal Council is proceeding to finalise regulations for the conduct of monitoring and inspection and to update its Guidance.
- The General Legal Council plans to commence its inspections in September 2023, while the filing of accountant’s reports on attorney’s compliance will be required in 2024.
